Terms and Conditions

These terms apply whenever you buy from finnandestella.com. Please read them before you order. Nothing here takes away rights you have under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002.

2. Placing an order

Adding something to your basket is not an order. An order is placed when you complete checkout and pay. We will email you a confirmation. A contract of sale comes into being once we accept your order and we may decline an order, for example if an item is out of stock or a price was listed in error. If we decline, we refund you in full.

3. Prices and payment

  • All prices are in South African Rand.
  • VAT treatment: All prices include VAT.
  • Payment is taken at checkout through Payfast. We never see your full card details.
  • We may change prices at any time, but never after you have paid for an order.

4. Delivery

  • We deliver anywhere in South Africa.
  • Delivery is free on orders over R3000.
  • Delivery charges below that threshold: Gauteng R100, Eastern Cape R200, Western Cape R200, other provinces R150.

Timeframes are estimates, not guarantees. Please give a delivery address where someone can receive the parcel. If a delivery fails because the address was wrong or nobody was available, a further delivery charge may apply.

5. Cancelling within seven days

Because you are buying online, section 44 of the Electronic Communications and Transactions Act gives you the right to cancel without giving a reason within seven days of receiving your order. Return the goods unused and in their original condition and we will refund the purchase price. You pay the cost of returning them. This is in addition to your rights below.

6. Returns, refunds and exchanges

  • Faulty or not as described. The Consumer Protection Act gives you six months to return goods that are defective, unsafe or not as described. You choose a refund, a replacement or a repair, and we carry the cost of the return.

  • Refunds are made to the original payment method.

7. Colours and product descriptions

Our products are printed and photographed as accurately as we can manage, but screens vary and colour will never be exact. Small differences in shade between the photograph and the item you receive are normal and are not a defect. Sizes are given as accurately as possible, with small manufacturing variation to be expected in handmade and hand-finished items.

8. Availability

We try to keep stock levels accurate. If something you ordered turns out to be unavailable we will contact you and offer a replacement or a full refund.

9. Your account

You are responsible for keeping your account password to yourself and for anything done through your account. Tell us straight away if you think someone else has access. We may suspend an account that is being used fraudulently or abusively.

10. Our designs and this website

The prints, photographs, text and design on this site belong to us or are used with permission. Buying a product does not transfer any rights in the artwork. You may not copy, reproduce or resell our designs or site content without our written permission.

11. Liability

We are responsible for loss that we cause you and that the law does not allow us to exclude. Beyond that, and to the extent the law permits, we are not liable for indirect or consequential loss, and our liability for any order is limited to what you paid for it. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud.

12. If something goes wrong

Please contact us first. Most things are sorted out quickly. If we cannot resolve it, you may refer the matter to the National Consumer Commission or a recognised consumer goods ombud.

13. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

14. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top shows when this page last changed.
